Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the IOModel platform available at iomodel.tech and app.iomodel.tech (the “Service”), operated by IOModel Tech (“IOModel Tech”, “we”, “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

IOModel Tech provides tools to design, document, validate and explore software architecture using an Architecture-as-Code and Documentation-as-Code approach — including model editors, visualisations, collaborative documentation and related APIs.

Functionality, availability and pricing of specific features may change over time. We will make reasonable effort to provide notice of material changes.

To use the Service you must create an account with a valid email address, either by registering with a password or by using a supported third-party sign-in (currently Google). You are responsible for:

• providing accurate, up-to-date information;
• keeping your credentials confidential and your account secure;
• all activity that occurs under your account.

You must be at least 16 years old to use the Service.

You agree not to:

• use the Service to violate any applicable law or third-party right;
• upload malware, exploits or otherwise harmful code;
• attempt to access, probe or disrupt systems, accounts or data you are not authorised to access;
• reverse-engineer, scrape or abuse the Service in a way that imposes an unreasonable load;
• resell or sublicense the Service without a separate written agreement;
• use the Service to store or transmit content that is infringing, defamatory, obscene, or otherwise unlawful.

We may suspend or terminate accounts that violate these rules, with or without notice, at our reasonable discretion.

You retain all rights to the content you create, upload or import into the Service (“Your Content”). You grant IOModel Tech a worldwide, non-exclusive, royalty-free licence to host, store, process, display and transmit Your Content solely as necessary to provide the Service and features you explicitly request (for example, sharing a project with collaborators).

You are solely responsible for Your Content and for ensuring that you have the rights necessary to submit and process it through the Service.

The Service, including its source code, UI, design, logos and documentation, is the property of IOModel Tech or its licensors and is protected by applicable intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with the Terms; they do not transfer any ownership rights.

The Service integrates with third-party products that you choose to use, including Google (for sign-in). Your use of those products is subject to their own terms and privacy notices. IOModel Tech is not responsible for third-party services.

The Service currently offers a free plan with no credit card required. Paid plans, if introduced, will be clearly identified and subject to the pricing shown at the time of purchase. Fees are non-refundable except where required by law.

To the maximum extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement or uninterrupted operation.

To the maximum extent permitted by law, IOModel Tech shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amounts paid by you to IOModel Tech in the 12 months preceding the claim, or (b) USD 50.

You agree to defend and indemnify IOModel Tech from any claim, damage, loss or expense (including reasonable legal fees) arising out of (i) Your Content, (ii) your use of the Service in violation of these Terms, or (iii) your violation of any applicable law or third-party right.

You may stop using the Service and delete your account at any time through your account settings. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately; sections that by their nature should survive termination (ownership, disclaimers, limitations of liability, indemnification, governing law) will continue to apply.

We may update these Terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be resolved by the competent courts of the Republic of Kazakhstan, unless a different forum is required by mandatory local law applicable to you as a consumer.
